‘SWANN INSURANCE’S NEW YOUR BILLPROTECT’ Radio Campaign
1. Information on how to enter and prize details form part of the Terms & Conditions of Entry. By participating, entrants agree to be bound by these Terms & Conditions of Entry.
2. The promotion is known as SWANN INSURANCE’S NEW YOUR BILLPROTECT Radio Campaign (Promotion).
3. Entry to the Promotion is open to all permanent residents of Australia 18 years of age or older. A participant may submit one entry into the Promotion.
4. Officers, management and employees (and their immediate families) of Swann Insurance (Aust) Pty Ltd (the Promoter), companies associated with the Promotion and their associated agencies are not eligible to enter.
5. The Promotion commences at 9:00am Australian Eastern Daylight Saving Time (AEDST) on 7 March 2010 and ends at 4:00pm AEST on 31 May 2010 (Promotion Period).
6. To gain an automatic entry into the Promotion, entrants must, during the Promotion Period, go to the SWANN INSURANCE website (http://swanninsurance.com.au/products/yourbillprotection) or ring SWANN INSURANCE (1300 307 926) and take out a Your BillProtect Policy.
7. The Promotion is a game of chance. All valid entries received by the Promoter during the Promotion Period will form part of one random draw. Promoter reserves the right to request the winners of the major prize draw (Prize Winners) to provide proof of identity and proof of age. The form of identification and/or proof of age as well as authorisation and release are at the discretion of the Promoter. Failure to provide such proof, authorisation or release will immediately invalidate a Prize Winner’s entitlement to the Prize, subject to state/territory legislation.
8. The prize draw will be held at Swann Insurance Head Office, Melbourne CGU Centre, 181 William St, Melbourne, 3000 on 17 June 2010 at 9:00am Australian Eastern Standard Time (AEST). The first valid entry drawn in the prize draw will be the Prize Winner.
9. The Prize Winner will be notified in writing on 17 June 2010 and the Prize Winner’s name will be published in the Public Notices section of The Australian newspaper on 24 June 2010. All decisions and actions of Promoter and its staff will be exercised according to their absolute discretion.
10. There will be one Prize Winner from the random prize draw who will receive the following prize: All bills paid for 12 months, to the maximum value of $10,000. Total value of prize is up to AUD$10,000 (Prize).
11. The Prize is not transferable or exchangeable. The Prize is not redeemable for cash or kind and must be taken as offered.
12. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the Prize or a part of the Prize by the time stipulated by the Promoter, then the Prize or that part of the Prize will be forfeited.
13. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
14. Acceptance of the Prize constitutes consent on the Prize Winner’s part to allow the use of the Prize Winner’s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.
15. If a Prize is unclaimed by 5:00pm Australian Eastern Daylight Saving Time (AEDST) on 17 September 2010, a second chance draw will be held at Swann Insurance Head Office, Melbourne CGU Centre, 181 William St, Melbourne, 3000 at 9:00am AEDST on 20 September 2010 subject to any written directions given by State/Territory Authorities. The winner will be notified in writing on 20 September 2010 and their details will be published in The Australian newspaper on 27 September 2010.
16. Promoter’s decision is final. No correspondence will be entered into.
17. Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. Promoter reserves the right to disqualify the winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this paragraph 17. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
18. Promoter takes no responsibility for lost, late, incomplete or misdirected entries.
19. Promoter accepts no responsibility for any tax implication that may arise from the Prize winnings. Independent financial advice should be sought by Prize Winner prior to accepting the Prize.
20. If for any reason the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes, which corrupt or affect the fairness or integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Promotion, subject to written directions from State/Territory Regulatory bodies.
21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking of the Prize.
22. All entries become the property of Promoter and may be used for promotional purposes without any further reference, payment or other compensation to the entrant. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, promotions or goods and services provided by the Promoter and, as required, disclose such information to Australian regulatory authorities. Entry is conditional on providing this information. If you elect to receive information from third parties, the Promoter may also disclose your personal information for that purpose. You consent to the Promoter’s use and disclosure of information about you as contemplated by this paragraph. To remove your information from the Promoter’s records, please send an email to info@swanninsurance.com.au with your name, mobile phone number and your request to cancel the service. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information that the Promoter holds about them or obtain a copy of the Promoter’s privacy policy by contacting the Promoter at info@swanninsurance.com.au.
23. Prize Winner acknowledges that the Prize is subject to additional terms and conditions imposed by third parties. The Prize Winner must become acquainted with any such additional terms and conditions prior to taking the Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Prize, nor for the breach of those conditions by any person.
