‘SWANN INSURANCE’S ULTIMATE RACING WEEKEND AT PHILLIP ISLAND’ Promotion

1) Information on how to enter and prize details form part of the Terms & Conditions of Entry. By participating, entrants agree to be bound by these Terms & Conditions of Entry.

2) The promotion is known as SWANN INSURANCE’S ULTIMATE RACING WEEKEND AT PHILLIP ISLAND promotion (Promotion).

3) Entry to the Promotion is open to all permanent residents of Australia 18 years of age or older. A participant may submit one entry into the Promotion.

4) Officers, management and employees (and their immediate families) of Swann Insurance (Aust) Pty Ltd (the Promoters} companies associated with the Promotion and their associated agencies are not eligible to enter.

5) The Promotion commences at 9:00am Australian Eastern Standard Time (AEST) on 8 June 2010 and ends at 5:00pm AEST on 31 August 2010 (Promotion Period).

6) To enter the Promotion, entrants must, during the Promotion Period, go to the Swann Insurance website (http://www.swanninsurance.com.au/products/motorcycle) or ring Swann Insurance (1300 307 926) and renew your Motorcycle policy.

7) The Promotion is a game of chance. All valid renewals received by the Promoter during the Promotion Period will form part of one random draw. Promoter reserves the right to request the winners of the major prize draw (Prize Winners) to provide proof of identity and proof of age. In addition, the Prize Winners and their travel companions will each be required to sign a release, which, among other things, will require the Prize Winners and their travel companions to accept responsibility for the acts and forbearances of the Prize Winners and travel companions. If a Prize Winner elects to take a travel companion who is under the age of 18 years, the Prize Winner will be required to sign a release and accept responsibility for the acts and forbearances of any travel companion under the age of 18 years. The form of identification and/or proof of age as well as authorisation and release are at the discretion of the Promoter. Failure to provide such proof, authorisation or release will immediately invalidate a Prize Winner’s entitlement to the Prize, subject to state legislation.

8) The prize draw will be held at Swann Insurance Head Office, Melbourne CGU Centre, 181 William St, Melbourne, 3000 on 1 September 2010 at 3:00pm AEST.

9) The Prize Winners will be notified in writing on 2 September 2010 and the Prize Winners’ names will be published in the Public Notices section of The Australian newspaper on 20 September 2010. All decisions and actions of Promoter and its staff will be exercised according to their absolute discretion.

10) There will be 3 Prize Winners from the random prize draw who will each receive the following prize:
a. return economy class airfares for the Prize Winner and one travel companion from the Prize Winner’s nearest capital city to Melbourne, departing on 15 October 2010 and returning on 18 October 2010;
b. three nights’ shared accommodation in a four star hotel from 15 to 17 October 2010;
c. arrival and departure car transfers from Melbourne airport to the hotel;
d. free access for two to Swann Insurance’s corporate facilities at Phillip Island from 15 to 17 October 2010 including hospitality;
e. transfers to and from Phillip Island race track; and
f. two tickets to a corporate dinner featuring Casey Stoner on 15 October 2010.

Total value of each prize is AUD$3,100 (Prize). The total value of the Prizes awarded in the Promotion is AUD$9,300.

11) Prize tickets are subject to availability at the time of booking. The Prize does not include meals (other than as stated above), stopovers, hotel car parking, hotel incidentals, ground transportation, taxes not included in the price of the ticket, visas, passports, gratuities, merchandise or any other costs of a related, ancillary or incidental nature not stated. Compliance with any health or other government requirements, other travel documentation and any extras of a personal nature eg. tips, telephone, laundry etc. are the responsibility of the Prize Winner and their nominated travel companion. Prize travel is subject to fare rules and other carriers conditions of carriage. Tickets will not be exchanged for another destination. The Prize Winner and their nominated travel companion cannot upgrade any Prize travel or Prize accommodation using cash or frequent flyer points and will not accrue frequent flyer points on any Prize flights or on any Prize accommodation. The Prize Winner and their nominated travel companions must travel together on the same flights on all sectors and stay together at the nominated hotel. Prize travel must be taken on the dates specified above. Prize travel may not be changed under any circumstances. If the Prize Winner cannot travel in accordance with this clause and on the flights nominated by the Promoter, the Prize will be forfeited. If for any reason the Prize Winner does not take an element of the Prize during the stated period, and on the conditions stipulated by the Promoter or any third parties, then that element of the Prize will be forfeited and cash will not be awarded in lieu of that element of the Prize. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination.

12) Travel, medical and any other insurance are not included in the Prize and are the responsibility of the Prize Winner and their travel companions. Travel, medical and other insurance are highly recommended.

13) Promoter accepts no responsibility for any variation in the value of the Prize. The Prize is not transferable or exchangeable. The Prize is not redeemable for cash or kind and must be taken as offered. In the event the Prize is not available, the Promoter reserves the rights to substitute a prize of equal or greater value, subject to the written directions of any relevant authority.

14) Acceptance of the Prize constitutes consent on the Prize Winner’s part to allow the use of the Prize Winner’s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.

15) If a Prize is unclaimed by 2:00pm Australian Eastern Daylight Time (AEDT) on 1 December 2010, a second chance draw will be held at Swann Insurance Head Office, Melbourne CGU Centre, 181 William St, Melbourne, 3000 at 3:00pm AEDT subject to any written directions given by State Authorities. The winner(s) will be notified in writing on 2 December 2010 and their details will be published in The Australian newspaper on 15 December 2010. If an element of the Prize is an event that has occurred prior to the unclaimed Prize draw date, that element of the Prize will be forfeited and no prize substitute will be offered.

16) Promoter’s decision is final. No correspondence will be entered into.

17) Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. Promoter reserves the right to disqualify the winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this paragraph 17.

18) Promoter takes no responsibility for lost, late, incomplete or misdirected entries.

19) Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as the Prize. To the extent permitted by law, Promoter, its related bodies corporate and their associated agencies, and any company associated with the Promotion, shall not be liable for any loss or damage whatsoever to person or property and including, but not limited to, direct (including economic) or indirect/consequential (including economic) loss by reason of any act or omission, deliberate or negligent, in connection with the arrangement for supply, or the supply, including any damage in transit of any goods/services by any person to the Prize Winner or their travel companion or for personal injury suffered or sustained, as a result of accepting, taking part in and/or using the Prize. Subject to the foregoing, if the Promoter is liable for any claim by an entrant, Prize Winner and/or travel companion, including a claim arising from the Promoter’s negligence, the Promoter’s liability for any such claim will not exceed AUD$1,000.00.

20) Promoter accepts no responsibility for any tax implication that may arise from the Prize winnings. Independent financial advice should be sought by Prize Winner prior to accepting the Prize.

21) Swann Insurance will provide services that permit the running of the Promotion. In doing so and for that purpose only, Swann Insurance may collect your details and provide them to Promoter and others for that same purpose. If you are not willing for this to occur you cannot participate in the Promotion.

22) If for any reason the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes, which corrupt or affect the fairness or integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Promotion, subject to the written directions of any relevant authority.

23) All entries become the property of Promoter and may be used for promotional purposes without any further reference, payment or other compensation to the entrant. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, promotions or goods and services provided by the Promoter. If you elect to receive information from third parties, the Promoter may also disclose your personal information for that purpose. You consent to the Promoter’s use and disclosure of information about you as contemplated by this paragraph. To remove your information from the Promoter’s records, please send an email to info@swanninsurance.com.au with your name, mobile phone number and your request to cancel the service. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information that the Promoter holds about them or obtain a copy of the Promoter’s privacy policy by contacting the Promoter at info@swanninsurance.com.au.

24) Prize Winner acknowledges that the Prize is subject to additional terms and conditions imposed by third parties. The Prize Winner must become acquainted with any such additional terms and conditions prior to taking the Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Prize, nor for the breach of those conditions by any person.
